Important legal consideration: If you\'ve posted an article on CMON, please take a look at this.

You\'re right Rev. I have been very negative lately :( I\'m often told that I\'m very bubbly and kind and blessed with a sunny disposition so I find this worriesome. I think I\'ve been reading too many forums and following too many threads that start out with good ideas and interesting opinions and instead of seeing them discussed and brainstormed watching them devolve into name calling and personal attacks. It makes me so very low. Forums are so addicting though. I think the best thing would be for me to go cold turkey. My best to all :)

Having just read this thread from start to finish - no small task I can tell you! - I am a little worried.

When I see a really good article on CMON, I usually pull it into Word, run spell checker/pigeon english checker, jiggle it about a bit so it fits nicely on x pages and then print it out for reference. (I have a nice display book with them in)

Does this mean I too an elligible for a lynching??? If it helps I don\'t let anyone else read them - not even Avicenna - and they are purely for my pleasure (cue Homer voice) ::Mmmmm....pleasure.....::

I don\'t mean to make light of this thread, as I do not agree with what the bloke has done - certainly not to make money from other people\'s hard work - but I wanted to be sure that people who have written articles are happy with what I (and probably others) have done with them.

I do own a shredder, so am happy to convert the pages into Limited Edition CMON Confetti available at £2.50 a bag
:innocent: ;)

I do this sort of thing all the time..I have 3, 3 ring binders full of such articles and pictures of painted minis. I use this for referance for myself as I don\'t paint in the same room as my PC.

I should do this... lots of minis I\'d like for reference, that aren\'t in the increasingly-aged Annual... I wish we had a colour laser at work ;)

Hmm, if you can help me on a spellchecked version of mine I might forgive you. ;)

Seriously. there is a large difference between this and what the other guy was doing. In his case he was profiting of efforts of people on this forum without even having the decency to ask for permission. What you\'re doing is keeping information for yourself (and in your case I think we can consider Avicenna as part of yourself too :) ) which was put here to share with other members anyway. So that\'s ok I\'d say.
I\'m having an interesting discussion about this on another forum at the moment. I don\'t know if anything special has already been entered into IP laws about things like usenet, maillinglists and forums but thing is that by participating yoou are basicly in a community where the main goal is to learn from eachother and have a good time. So sharing info is one of the basics. Being allowed to store eachtothers\' info for your own use would be an implied license I guess.

Oh, and if not, you can always put it under
\"for study\" which is one of the allowed fair use possibilities.

Bye, Ming-Hua

P.s. seriously about my remark. If you have actually corrected text the authors might be interested in a copy of that to update their articles.

I took the skin up with Klute thread and reduced that to a skin painting tute.

Best one I’ve come across. So if you want it back Klute I\'ll send it to you. Or you could post it as a tute.

I like the idea of a folder tho. I print most articles out but they just end up in a pile somewhere.

Perhaps someone should volunteer to make the tutes into a painting manual with the profits going to CMON. I give permission for my tute (such that it is) to be used by CMON.

\"So if you want it back Klute I\'ll send it to you\"

Not at all.
I said before I post articles to help people and fully expect some to be saved and printed out. I even wouldnt mind the print out being passed on to others. Its the selling them for money that crosses the line.

I got some information passed to me; GW\'s legal team are looking at this as well, not on our behalf, but as he has sold this ebook under a Description of \"The Warhammer Ultimate guide to Miniature Painting.\" Infringement of Trademark.

Methinks this young man may no longer need a laxative. :D

GW\'s involvement might be due to the fact I discussed this with my local GW store manager.

Good on ya. The first thing I noticed was the GW logo on his auction and was wondering what the hell it had to do with anything.

Stupid guy.

Wow I just found this thread. Legally, he is an asshole. First off, I believe that any article or image posted on CMoN is the property of CMoN and the artist. If not, it should be. When you look at the bottom of the Toadstool gallery that Terry Adams set up, it specifically states:

\"All images are copyright of the painters. Any other content is copyright the creator of said content. \"

This is simple.

As for this case, many of us, including myself (my Jade totem is right on the ebay advert), have taken time to produce articles like these to help other painters in THIS community. We have done it for free, spending some large amounts of time doing so, without desire for accolades, payment or anything. The articles are and should be the property of us, either individually, or as a COMMUNITY.

For this asshead to take the articles without permission, recognition or any form of compensation is not only rude, but illegal IMO.

I have wrote to ebay and him about it and am considering Mike\'s mail-in Cease and Desist form.

This is more than simply hotlinking images, or posting them without permission.

He has stolen our efforts and is profiting from them.

Be pissed off. I am.

Hi Glyn

It was the Jade totem that made me look further into it.

Personally I cant be bothered for certain reasons to take it any further than get my money back from him.

I liked your line about the articles belonging to the community.

I\'m just glad that the spelling of \'cease and desist\' was settled earlier on in the thread. Bad spelling is pongy lol

Decist anyone? Terrible! lol

I hate tradition

I\'m a lawyer and one of the things I hate about the law is the stupid adherence to tradition.

Cease and desist? What, both? I have to stop doing something and I have to stop doing something?

Stupid William the Conqueror...*mutters incoherently*

Good going Mike! Now that he is up against it with a corporate Behemouth like GW, you\'re right, he won\'t need a laxative for a long time. I suspect any money he has made will be well used up, plus some, in defending himself from the onslaught that is probably coming his way... he,he
