Ultra Forge’s first production miniature on sale May 15th

I suppose you have a point Sturm, but just because it has some resemblance, whether intended or not (and I would say it was for this one) that if the wording was changed a bit and the picture of the WH40k stuff was removed, that she should be able to sell it.

Hell, for that matter, any male loin clothed sword wielding barbarian is just a bit too close to Conan ... right? I think in some instances its just taken a bit too far.

But then again, I don\'t run a buisness, so my view is likely biased in the extreme to be truthful.

I don\'t know if the way it looked was the problem, but putting any GW imagery in the ad, like the scale picture and any names, would be a issue. Since I can\'t see the ad now I\'m not totally sure, but I do think it referred indirectly to GW products. Changing the name to something else like corrupted demonic spaceguy (or something better :) ) should solve some of the problem, and then removing the scale bit would fix the rest.

When I re-list my auctions I am going to keep them very safe for now on.

The scale image was perhaps a little much, although it was a great help. I am going to do my new photos with rulers instead.

I have also finished sculpting my own 50 mm rounds bases, with some nice detail. The base alone is quite a cool piece, and I am glad I did it. I will be including it in all my future sculptures.

I will also not be including my auctions in the miniature wargames catagory. I will be putting it in the sculpture category.

I hope that after all of this effort that I will be left alone.

The simple truth is that my sculptures do not infringe upon any other companies intellectual properties or registered trademarks. I am sure that Ebay just got the same letter from GW that it sends to take care of several issues. Hopefully I will have changed anything that bothered them in the first place.

I hold no ill will toward GW. It is ironic that they are the ones to police intellectual properties however. Almost no element that they design or promote is unique. They do however keep all of their manufacturing domestic, and they do the world’s best job of promoting tabletop war gaming.

I am just looking forward to getting my new minis out there. Speaking of which, I am making the mold boxes for the next miniature in my Pestilence line tomorrow. I will have photos up as soon as I can get one painted... which could be a little while. :)

I am also re-casting a few more LoP\'s, as I never got to finish selling the last run. Thanks so much for the kind words and reviews.

Thanks also for the support. The coolminipeople are my biggest motivation right now. Well, that... and my new rent payments. Ugh. Oh yeah, I moved and my new place is pretty cool. I still got to paint though. Easier to paint a miniature then a wall in my opinion, hehe.

If you were in Copenhagen, I\'d come over and help paint..though I\'d stick to painting the walls!
 
Well come on now you mention that you sculpted bases but have not posted any picts. We want picts. :D

Edit: Good luck with ebay, hopefully they will not bend to the GW pressure again.

There is no way you typed that with a straight face. It seems you don\'t quite grasp what IP really is. You sculpted a Nurgle terminator. Period. There\'s no question about that. It is an attempt to appeal to an established market by working from another company\'s existing imagery. It doesn\'t matter if you use certain trademarked words, you could call the guy Rotting Robby, it\'s still IP infringement.

I don\'t quite remember reading about big boxy upper armor, gigantic shoulder pads, ribbed under armor, cloven foot armor, etc, etc in the descriptions of the four horsmen.

By law, GW MUST protect their IP from any known infringement possibilities or they lose the right to do so. This is clearly infringement and you\'ll receive a \"Cease and Desist\" letter as soon as the legal dept. becomes aware that the sculpt is being cast and sold. Then you\'ll be ordered to destroy the molds, etc, etc. and lose a lot of time and effort.

There\'s really no need for you to have to go through all that crap. Clearly you\'re a talented sculptor. How hard is it to come up with original schemes for your \"fourth horseman of the apocalypse: Pestilence\" that doesn\'t rehash another company\'s ideas? (A horse might be a good start:p) Hopefully we\'ll see some original work from you in the future.

And on another note, considering the size of theses models and that they aren\'t being vulcanized, green stuff, even a gs/polymer blend is less than an ideal medium.

Still, if your work is banned, Sophia, maybe the minis still waiting for me at the post office will pay for my kids\' college education 15 years from now...if you had to pay for college in Denmark.:D

I\'m surprised you can type that with a straight face when talking about GW. I think they should sue James Cameron and HR Giger for stealing the look of their last Hive Tyrant for his Alien Queen.......oh, wait a sec....

I tend to agree. In the large variety of comic and game art I come across, all of these elements are coming in to play in a wide variety of work. He\'s a pestilent space dude. If he was a pestilent fantasy dude you could still technically draw comparisons to GW IPs (nurgle fantasy). I don\'t feel that GW has the market cornered on \"rot\".

A nurgle terminator? Period? Damn, I thought I had a few terminators in my collection, but it seems they were mis-sold to me, as they aren\'t the same as the models sophia is pimping. They\'re half the size for starters! Damn GW bastards, I want a refund!

Glad to see you\'re so sure of this. How long have you worked in the GW legal dept? (I suppose you think that \"informer\" is an official position though, so maybe you do work there).
