I got the e-mail and suspected foul play from a corporation that realy has nothing to worry about. In my mind it is typicaly GW style business anyway I hope you succeed Sophia as I am very impressed with the miniature you produced and certainly look forward to seeing more from Ultra-Forge.
The only thing I think that came close to their copyright was the use of the terms Deamon Prince but that is nitpicking if that is what it was.

Your minis are cooler than GW\'s daemons and people would definitely use yours in their Warhammer armies. GW shut you down simply because they can.

I do not understand copyrights but on the box of the Daemon Prince for WH40K it does say this,

\"Eavy Metal, Games Workshop, the Games Workshop Logo, Citadel, the Citadel Castle and Warhammher are trademarks of Games Workshop Ltd, registered in the UK and other countries around the World. The copyright in this box and its contents is the property of Games Workshop Ltd, all rights reserved.\"

In the box is one Chaos Daemon Prince hence the infringement of the copyright.

But like I said that is nitpicking and I fully agree with reverend\'s post.

I would think \'Daemon Prince\' is a fairly generic name that GW cannot claim to own.

And I agree with Rev\'s post as well. :D

Have to say, when I first saw the ultraforge mini I did instantly think GW! Can\'t be arsed mulling over the technical side of the law in these cases, but the figure just screamed GW and W40K to me!

Shame it pulled from Ebay, but that\'s the risk you take in making something that is so very close to GW\'s imagery. You live and learn I guess.

Okay, I gotta say that nowhere in the email from Ebay wdid Games Workshop\'s name figure...still, it could only be them.

You\'ll find pretty common words trademarked by all sorts of companies. A Trademark doesn\'t stop anyone else from using the word, it just stops anyone else from using it in a context where it could be mistaken for the trademarked original.

Utter bastards. I suggest you carry on selling it as a \'Pestilential Demon King\', and if they come knocking again, tell \'em to f*** right off.....
 
You know, I can understand how they can shut down some like Irondog Studios (great stuff - but it was all based off GW artwork) but something like this is just frigged up.

I can see how they size comparsion of miniatures might have made for some trouble, but they shouldn\'t of been able to shut you down at all. Hell, to me he looks like a Nazi Pulp Fiction soldier experiment gone wrong - way wrong.

I think I would fight this one, if for no other reason than GW is very much in the wrong here. You can also keep the name, as it is NOT copyrighted or trademarked by then. If you said he was a Nurgle Daemon Prince, yeah ... but I can point out three books and two game systems right now that use the word Daemon/Demon Lord/Prince whatever.

Wasn\'t my particular cup of tea - but it was very well done and I think you should have every opportunity to sell it.

To be fair FF... that model does look like a cross between the 40k demon prince, a terminator marine, and Typhus... with of course a healthy nurglesque coating. It\'s easy to see the comparisons, and that\'s all that\'s needed. The model is just very 40K plague marine... and that is quite clear. I know everyone\'s jumping to sopia\'s defence, but be fair... the imagery is quite clear! And anyway, they\'ve only shut down the Ebay auctions. It\'s not like they\'re suing her for breech of copyright or anything.

Hmmm...

If only GW invested as much time and effort in developing and improving their product as they did in hounding down individuals who may, or may not, have infringed their IP......they might stop haemorraging customers and profit???
